Approve the Resolution to amend said agreement, authorizing the appropriate Town officer to execute said agreement and authorize staff to expend budgeted funds.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
Background:
Archer Western was engaged as the CMAR for the pre-construction phase of the upcoming expansion of the North Water Reclamation Facility (NWRF). The CMAR provides input to ensure efficiencies in design and constructability, costing at various stages of design and ultimately provides a guaranteed-maximum-price which includes competitively bidding all project phases/disciplines. The resultant Guaranteed Maximum Price (GMP) represents the maximum price the Town will pay for the project (absent change orders approved by the Town). The Town has established a reasonable contingency for the project at roughly 5% and an allowance for repairs to an existing tank that has concrete damage due to hydrogen sulfide (H2S) gas present in wastewater. Archer Western has constructed numerous treatment facilities throughout the Front Range and Colorado over decades and has an excellent reputation.
