POLICY ISSUES:
Pursuant to Sections 8.03 and 9.01(4) of the Town's Home Rule Charter, Town Council may appoint Assistant Municipal Judges to act in case of temporary absence, sickness, disqualification, or inability of the Municipal Judge to act.


Recommendation
STAFF RECOMMENDATION:
Approve Resolution appointing Elizabeth Barajas as Assistant Municipal Judge of the Erie Municipal Court. Approve the Assistant Municipal Judge Services Agreement.

SUMMARY/KEY POINTS

* The Erie Municipal Court needs qualified Assistant Municipal Judges who may act in the absence of the Municipal Judge.
* Town staff previously advertised the position and received five applications. On March 10, 2026 Town Council appointed three Assistant Municipal Judges.
* The Municipal Judge and Court Administrator interviewed an additional candidate, Elizabeth Barajas on April 6 and recommend she also be appointed as Assistant Municipal Judge.


BACKGROUND OF SUBJECT MATTER:
The Erie Municipal Court currently has three appointed Assistant Municipal Judges. Multiple Assistant Municipal Judges are needed to ensure there is availability in the event of the Municipal Judge's absence or conflict of interest. The Assistant Municipal Judge will preside over Court sessions and handle Local Licensing Authority matters on an on-call, as-needed basis.
