BACKGROUND OF SUBJECT MATTER:

Six home rule municipalities are plaintiffs in litigation with the State of Colorado regarding State requirements of HB 24-1304 Minimum Parking Requirements and HB 24-1313 Housing in Transit-Oriented Communities. They are seeking injunctions against enforcement of the two bills.

 

The municipalities argue that the State requirements violate the Colorado Constitution, specifically Home Rule authority over local land use and zoning matters.
