POLICY ISSUES:
Staff's analysis indicates the proposed Development Agreement (DA) Amendment is consistent with the Town Charter, Municipal Code, and Council priorities. Approval of this amendment only extends the improvements deadline and adjusts the phasing plan and will facilitate the development of model homes for sales.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
Canyon Creek Filing No. 7 is comprised of 70+ acres, platted into 106 single-family detached lots, and is located on the northwest corner of Telleen Avenue and Lombardi Street.
Specifically, this DA amendment modifies the original DA in the following ways:
* Updates Exhibit C for the phasing plan.
* Extends the deadline for all phases set forth in Section 4.a. to Dec. 31, 2028.
* Allows model homes to be constructed in Phase 2 before initial acceptance of Lombardi Street from Telleen Avenue north to Jay Road.
Site History and Prior Approvals
1. Annexation:
The overall Canyon Creek area (including Filings 7 and 8) was annexed by the Town in September 1970, and was originally known as "Homestake".
2. Zoning:
* The properties and surrounding area were zoned as the Homestake PUD in 1975.
* In May 2001 the Homestake PUD was amended and renamed the Canyon Creek Planned Development (PD) Plan.
* Filing No. 7 of the PD was designated for 110 Single Family Detached units.
* The Canyon Creek PD was amended in 2021 to allow alley-loaded products within Filing No. 8.
3. Plats:
