Developer to pay $3,500.00 License Agreement

POLICY ISSUES:
Approving the License Agreement with the Regional Transportation District (RTD) allows for the construction of Colliers Hill Filing 6 Subdivision. Specifically, the Town agrees to abide by standard RTD requirements when constructing improvements impacting RTD right-of-way.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
On Dec. 10, 2024, the Town Council approved the Colliers Hill Filing No. 6 Development Agreement and accepted dedications as shown on the final plat for the filing.

Certain portions of the Colliers Hill development will impact RTD's property and railroad right-of-way in the vicinity of Weld County Road 5. The improvements involve the installation of a storm sewer pipeline under the railroad tracks adjacent to Weld County Road 5. Below is an image of the area and proposed improvements:



The Colliers Hill Developer will perform the construction and installation of the storm sewer improvements and be responsible for the operation and maintenance of the improvements until they are dedicated and accepted by the Town. RTD and the Developer entered into a License Agreement previously, but an agreement is also required with the Town.

Approving this License Agreement with RTD ensures the timely and efficient construction of the Colliers Hill development.
