POLICY ISSUES:

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
On Nov. 7, 2023, the registered electors of the Town of Erie approved the Town of Erie Home Rule Charter. Article 8.04 of the Charter requires the Town Council to appoint a municipal prosecutor, which must be an attorney licensed to practice law in good standing is the State of Colorado and shall be appointed for a definite term at a fixed compensation. Approving this resolution will formally appoint Hoffman, Parker, Wilson & Carberry, P.C. to serve as the Town’s municipal prosecutor, with the understanding that the majority of the municipal prosecution services will be performed by its subcontractor, the Ausmus Law Firm, P.C. Attorneys employed by Hoffmann, Parker, Wilson & Carberry, P.C. may provide municipal prosecution services as necessary.
Compensation for the municipal prosecutor services will be $3,500 per month for all services performed by the Ausmus Law Firm P.C. and $245 per hour for any additional services provided by attorney directly employed by Hoffman, Parker, Willson & Carberry, P.C.
