SUBJECT:

A Resolution of the Board of Trustees of the Town of Erie Approving the Payment of a $5,000 Bonus to Town Administrator Malcolm Fleming

DEPARTMENT:   Board of Trustees

PRESENTER(S):  Justin Brooks, Mayor

POLICY ISSUES:

Awarding a bonus in this instance would be consistent with the Town’s policy and practice of recognizing and rewarding performance that serves the Town well.

STAFF RECOMMENDATION:

Approve the resolution.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

Section 3.b of the Employment Agreement between the Town and Town Administrator Malcolm Fleming provides that Fleming is eligible to earn a one-time bonus of $5,000 payable in the Town’s 1st pay period of November, if in the Board of Trustees’ sole determination Fleming continues to demonstrate the Key Strengths and shows good progress on the Key Development Opportunities and Strategies for Growth listed in Fleming’s January 2023 Personal Development Plan.

The Board met in Executive Session on October 24, 2023 to discuss Fleming’s performance during the current period and to what degree he is eligible to earn the $5,000 bonus as per Section 3.b of the employment contract. After discussion and review, Mayor Brooks informed Fleming that the Board noted continued performance in areas that have been executing well, as well as adjustments and improvements that have served the Town well. Accordingly, the Board concluded Fleming has earned the full amount of the bonus. Approving the Resolution will formalize the Board’s direction on this matter.
