POLICY ISSUES:
The proposed Home Rule Charter has significant policy implications. However, under C.R.S. 31-2-207(1) the Board of Trustees has only 30 days from when the Home Rule Commission submits the proposed Charter to call the election and publish notice of the election including the text of the proposed Charter. Thus, the Board's policy role in this matter is constrained by State law.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
On Nov. 8, 2022 the electors of the Town of Erie voted to establish a Home Rule Charter Commission and elect a Commission to draft a Home Rule Charter. The Charter Commission held its first meeting December 1, 2022 and met almost every week after that until April 20, 2023, when they voted to approve the final draft of the proposed Charter. The Commission then submitted that proposed Charter to the Board of Trustees at the Board's April 25, 2023 meeting in compliance with C.R.S. 31-2-206.

Approval of Resolution 23-063 (attached) puts into motion the required next actions per C.R.S. 31-2-207:
* Publish and give notice of election to determine whether the proposed Charter shall be approved
* Such notice of election shall contain the full text of the proposed Charter
* Set the ballot language for the proposed Charter

Upon the Board's approval, the Town Clerk's office will cause the entire Charter to be published in the Colorado Hometown Weekly and initiate agreements with Boulder and Weld counties to participa...
