Recommendation

Staff recommends the Board of Trustees adopt Ordinance 21-2022 to establish a local process for handling local campaign finance complaints.

Summary and Background of Subject Matter:

Until recently, the Fair Campaign Practices Act, C.R.S. § 1-45-101, et seq., and rules promulgated by the Colorado Secretary of State included a process by which the Colorado Secretary of State handled all complaints involving campaign finance matters, even local matters.  A change in state law placed on municipal clerks the responsibility to handle local campaign finance matters.

 

As such, the Town needs to put a local process in place so that it is prepared to handle a campaign finance complaint involving a municipal campaign finance matter should one arise.  The Erie Municipal Code is currently silent on how a campaign finance complaint involving a municipal campaign finance matter would be handled.  The Ordinance creates a process the Town Clerk would administer that is procedurally similar to what the Colorado Secretary of State follows when handling campaign finance complaints on non-local matters.
