SUMMARY AND BACKGROUND OF SUBJECT MATTER:
In 2021, the Town of Erie acquired one Colorado Big Thompson (CBT) Unit from the Left Hand Water District (LHWD) pursuant to an Intergovernmental Agreement that requires LHWD to transfer one CBT unit to the Town for each water tap (i.e. connection to the water supply system) the Town takes over water service from LHWD. When CBT Units are first acquired in this manner, the Northern Colorado Water Conservancy District (NCWCD) grants a temporary use permit to allow the Town to use those Units for up to a calendar year without the need for formal approval for NCWCD. The temporary use permits are then converted into perpetual water contracts after application to and approval from the NCWCD Board of Directors.

The Town currently holds a 2021 temporary use permit for the CBT Unit from LHWD, and the Town now needs to apply to NCWCD to convert its temporary use permit into a perpetual water contract. To do so, the Town must sign and submit two application forms: Application to Northern Colorado Water Conservancy District for Annual Renewable Perpetual Water Contract for Right to Use Colorado-Big Thompson Project Water Under C.R.S. 37-45-131; and Application to Northern Colorado Water Conservancy District for Cancellation of Temporary Use Permit. These applications are attached and must be completed and submitted to NCWCD by March 1.
