Approve the resolution consenting to the assignment of the Sunset Filing No. 1 Final Plat development agreement (DA) from FS Erie Estates, LLC to Lennar Colorado, LLC

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The Final Plat and the Development Agreement for Sunset Filing No. 1 was approved by the Board of Trustees on December 14, 2021.
The Sunset Filing No. 1 Final Plat area is located west of Weld County Road 5, north of Weld County Road 6 and the Erie Singletrack, and south of Erie Highlands.
The current owner of the property (FS Erie Estates, LLC) wishes to convey the land to Lennar Colorado, LLC. The attached Resolution, provided for consideration by the Board of Trustees, will assign all rights, improvement obligations, covenants, promises, and requirements under and pursuant to the Development Agreement for Sunset Filing No. 1 Subdivision to Lennar Colorado, LLC.
