SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The Professional Services Agreement with the Town Attorney's firm (Hoffmann, Parker, Wilson & Carberry, P.C.), was approved in 2018. At that time, the hourly rate for general legal services was $195/hour, and it has remained at that rate since.  In 2019, the Professional Services Agreement was amended to add litigation services.  This Second Amendment would increase the hourly rate for general legal services from $195/hour to $215/hour, effective January 1, 2022.

The increased rate is consistent with other area municipalities with contracted municipal attorneys (as opposed to in-house, salaried attorneys).  The comparable rates are as follows, with some effective already and others effective on January 1, 2022:

Superior: $215/hour

Louisville: $215/hour

Lafayette: $205/hour

Golden: $215/hour
