SUMMARY AND BACKGROUND OF SUBJECT MATTER:
On February 11, 2014, the Town and the original owner of the property entered into an Annexation Agreement for the Andalusia property. On August 25, 2020, a new owner purchased the property subject to the Annexation Agreement and is successor in interest to the prior owner.
Pursuant to Section XI.C.1 of the Annexation Agreement, the owner is limited to providing no more than one (1) housing type and two (2) housing type variations.
The current owner wishes to remove this provision from the agreement to allow future development to follow the Unified Development Code’s housing diversity requirements. An existing Preliminary Plat application proposes more than one housing type, which is in conflict with the existing Annexation Agreement. Staff supports more than one housing type at this location and supports using the Unified Development Code as the default housing diversity standards
