SUMMARY AND BACKGROUND OF SUBJECT MATTER:
Since January 30, 2014, the Town of Erie has participated in an Intergovernmental Agreement (IGA) for household materials management (HMM) with Boulder County, City and County of Broomfield, the Town of Superior, and the cities of Boulder, Lafayette, Longmont, and Louisville. The current IGA is in effect until December 31, 2024, and this Second Amendment, if approved, clarifies Erie's financial commitment and gives final approval to use the restricted funds to finance the expansion of the Hazardous Materials Management Facility (HMMF).
An expansion of the Boulder County HMMF was anticipated when the Hazardous Materials Management IGA was approved in 2019. Erie has been paying an agreed-to 5% above annual operating costs to help fund the expansion. The 5% fee was not sufficient to fund the approximate $1,000,000 total cost of the expansion project, and the participating organizations are using this IGA to authorize additional payments for the project based on a percentage of their use of the facility. The expansion is modest and ensures continued operation at the capacity needed to serve the participating communities. Erie's current use of the HMMF is 3 percent and the annual contribution to the expansion fee is 5% (shown in the chart below).
