Recommendation

Approve resolution recommending the Town of Erie Board of Trustees approve the amendment to Section 10-7-20 of the Unified Development Code

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The purpose of the ordinance is to update a portion of Section 10-7-20 of the Unified Development code which addresses Improvement Guarantees which are used to ensure the installation of required public improvements that are associated with a final plat or site plan. The specific changes are to Section C - Methods, which identify the methods acceptable to the town for the Improvement Guarantee.  

The changes as outlined are as follows:

Add language to 10.7.20.C.1, to specify that the form of the escrow agreement will be in a form acceptable to the town.

Add language to 10.7.20.C.1.b, to specify that such guarantee shall also apply to “Partial Completion” of improvement, and

Adding a new Section 10.7.20.C.3 as noted in the Ordinance.  This additional language is needed for projects funded by the Town as well as the Town of Erie Urban Renewal Authority (TOEURA), because the Town is already funding these projects, so additional guarantees will only increase the Town’s costs (or TOEURA’s costs)

The Board of Trustees public hearing for this amendment is scheduled for August 24th, 2021.
