SUMMARY AND BACKGROUND OF SUBJECT MATTER:

This is an amendment to a portion of the current UDC as it relates to Planned Developments (PD). Currently, the UDC restricts the sections of the UDC that may be modified by a PD to Chapter 3: Use Regulations; Chapter 4: Dimensional Standards; Chapter 5, Section 5.4: Layout and Design of Subdivisions; and, Chapter 6: Development and Design Standards. The UDC amendment would allow modification by PD to any section of the UDC. The amendment is proposed to accommodate the implementation of PD regulations for the Erie Town Center where DPZ is recommending modification of review processes in Chapter 7.

 

Planning Commission reviewed the agenda item on February 5th and recommends approval.

 

Below are the approval criteria you are to use when reviewing and making recommendation on the proposed UDC Amendment. Staff finds the proposed amendment meets the approval criteria and is recommending approval.

a.                     The proposed amendment will promote the public health, safety, and general welfare;

b.                     The proposed amendment is generally consistent with the Town’s Comprehensive Master Plan and the stated purposes of this UDC; and

c.                     The proposed amendment is necessary or desirable because of changing conditions, new planning concepts, or other social or economic conditions.
