SUMMARY AND BACKGROUND OF SUBJECT MATTER:
Per the Erie Highlands Filing No. 11 Development Agreement (dated February 28, 2017) the developer, Clayton Properties II, Inc. d/b/a Oakwood Homes, is responsible for a neighborhood park and landscaping improvements. To ensure a high quality park with amenities that complement other Town parks, staff worked closely with Oakwood Homes and Terracina Design to complete the master plan for the Erie Highlands neighborhood. The master plan for the neighborhood park, now named Clayton Park, was approved by the Board of Trustees on November 13, 2018.
Town staff then worked with Terracina to complete construction documents and final cost estimate and the project is now in the construction bid phase. Under the Town’s neighborhood park development policy adopted in 2017, Oakwood Homes chose to have the Town be responsible for managing the bid process, contractor selection and oversight of construction.
With Neighborhood Park Agreement (attached) Oakwood homes agrees to convey the park property to the Town on or before December 11, 2019, and pay the Town $2,025,000 to fund the cost of park construction. Approval of this Agreement satisfies Oakwood Homes’ responsibilities of completing the neighborhood park in the Erie Highlands neighborhood as required by the development agreement.
Staff anticipate bringing forth a resolution at the December 10, 2019 Board meeting to award contracts for the owners’ representative and construction contractor for this park to be completed in 2020.
