SUMMARY AND BACKGROUND OF SUBJECT MATTER:
An important facility for the delivery of raw water to the Town is the Southern Water Supply Project ("SWSP"). It is comprised of a pipeline and pump stations which delivery the Town's water supply from Carter Lake to the Town's treatment plant. That water supply consists of Units in both the Colorado Big Thompson Project ("CBT Units") and the Windy Gap Project. There are 14 participants in the original SWSP, which is now known as SWSP I. The Carter Lake Outlet Works were modified and increased in size to provide water to the SWSP I ("Carter Lake Outlet Works Modification").
Three entities which did not participate in SWSP I are now constructing a second parallel pipeline known as SWSP II. Deliveries of water from Carter Lake to the SWSP II Participants will be made through the Carter Lake Outlet Works Modification. The Agreement provides for payment from the SWSP II Participants to the SWSP I Participants for pro-rata costs previously expended by the SWSP I Participants for the construction and upgrades to the Carter Lake Outlet Works.
Based upon Erie's capacity of 5.5 cfs in the SWSP I, Erie is entitled to a reimbursement of $24,995.48 from the SWSP II Participants. The Agreement sets forth the terms for said reimbursement.
