Authorize the Mayor to execute the Contracts for Capacity in the Southern Water Supply Project.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

An important facility for the delivery of raw water to the Town is the Southern Water Supply Project (“SWSP”).  It is one of the pipelines which delivers the Town’s water supply from Carter Lake to the treatment plant.  That water supply consists of Units in both the Colorado Big Thompson Project (“CBT Units”) and the Windy Gap Project.

The Town’s capacity in the SWSP derives from an initial allotment contract, entered into in 1994, subsequent allotment contract for increased capacity with construction of the Longmont Pump Station in 2001 and capacity purchased from the Superior Metropolitan District No. 1 in 2003.

Several parties who did not participate in the SWSP are now pursuing a second parallel pipeline known as SWSP II.  In order to differentiate between the projects, the original pipeline is known as SWSP I.

The attorneys for the Northern Colorado Water Conservancy District (“NCWCD”) and the SWSP Enterprise requested all Participants in the SWSP I to execute an agreement to recognize the total capacity that each entity currently owns.  The reason for the agreement is that the SWSP Enterprise long ago stopped differentiating between capacities under the original allotment contract and the subsequent allotment contracts.  It is necessary to reflect the total capacity that each Participant owns in order to allow Participants to convey capacity among one another including capacity in the Modified Carter Lake Outlet Works, which was part of SWSP I.

Staff recommends that the Board of Trustees authorize the Mayor to execute the Allotment Contracts for Capacity in the Southern Water Supply Project so that Erie’s capacity in SWSP I is described in the same manner as all other Participants.

Board Goal:  This serves the Board’s goal of maintaining current contracts with NCWCD for all facilities and water rights.
