SUMMARY AND BACKGROUND OF SUBJECT MATTER:
On June 12, 2018, the Board of Trustees accepted easements and dedications as shown on the Morgan Hill Filing No. 1 Final Plat and authorized the Mayor to sign the Morgan Hill Filing No. 1 Development Agreement following the Director of Planning and Development’s conditional approval of the Final Plat. The fourth condition of approval by the Director stated that “Access sufficient for long term maintenance of public facilities shall be established and a recorded copy of the fully executed agreements shall be submitted.” The attached Access Easement Agreement between the underlying property owner and the Town satisfies this condition and provides the Town access to Town sanitary and drainage improvements the Morgan Hill developer is responsible for constructing. The Resolution, provided for consideration by the Board of Trustees, accepts the Access Easement Agreement.
