SUMMARY AND BACKGROUND OF SUBJECT MATTER: As a condition of approval of Morgan Hill Filing No. 1, the slope easements, originally obtained by Weld County for maintenance purposes, were required to be vacated. The Town of Erie assumed maintenance responsibilities for CR 10.5 when it was annexed. As part of the development of Morgan Hill Filing No. 1, CR 10.5 will be improved and the adjacent areas developed in a manner inconsistent with the easements, thus rendering the easements obsolete. Weld County has given the Town a quit claim deed dedicating the easements to the Town so that we can vacate them. Vacation of these obsolete easements is a technical clean up that eliminates the easements to accommodate the approved development of Morgan Hill.
