SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The Resolution, provided for consideration by the Board of Trustees, authorizes the appropriate Town Official to execute the South Boulder Canon Ditch Company, The Town Of Erie, and Matthew T. And Kristen R. Starr Ditch Easement Relocation Agreement. The portion of the South Boulder Canon Ditch located at the southeast corner of Arapahoe Road and Highway 287, also known as Nine Mile Corner, currently bifurcates Town property and the Starr property. The ditch relocation agreement between the three aforementioned properties allows for the Town to relocate the portions of the ditch in the subject properties to the western and southern edges of the development in a pipeline to provide for the orderly development of the Nine Mile Corner property. The agreement provides for construction of the pipeline within a new easement that allows the ditch water to be conveyed through the property. The ditch company in turn will quit claim the right, title, and interest in the existing ditch’s alignment to the respective property owners.
