SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The master developers (Tallgrass Investors, LLC and CDG of Erie, Inc.) and homebuilders (Richmond Homes and Shea Homes) of Phase 1 of the Colliers Hill development have requested to amend the Bridgewater Annexation Agreement. The proposed amendment would provide the homebuilders an additional two years, from four years to six years, to either; a) pull building permits, or b) pre-pay for water/sewer taps, raw water fees and impact fees for all lots within Phase 1 of the development. The initial four year period will end on May 24, 2017 for Filings 1A through 1D.
The proposed amendment affects a total of 15 lots within Filings 1A, 1B and 1D that are vacant lots adjacent to existing model home complexes. Staff supports the additional two year extension versus the pre-payment of the identified fees due to the accounting and logistical issues presented when partial payment of building permit fees are made.
