SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The Urban Drainage and Flood Control District (UDFCD) was established by the Colorado legislature in 1969, for the purpose of assisting local governments in the Denver metropolitan area with multi-jurisdictional drainage and flood control problems. The Boulder County portion of Erie is within UDFCD boundaries. The Weld County portion currently is not included.
Town Staff has requested project management and construction assistance from UDFCD for improvements to Coal Creek between County Line Road and Kenosha Road which is within UDFCD’s boundaries. Depending upon available funding, UDFCD will fund up to 50% of the design, right-of-way acquisition and construction of drainage and flood control improvements. At the August 25, 2015 Board of Trustees meeting, the Board of Trustees approved the first agreement and $50,000 to begin the funding for improvements to Coal Creek for this segment. At that time, UDFCD also budgeted and approved $50,000 to put towards this project. This year both UDFCD and Erie have $500,000 budgeted for improvements to this section of Coal Creek.
The Town also has $275,000 in the 2017 budget for design of improvements to Coal Creek between the existing levee north of Cheesman Street and County Line Road. This section of Coal Creek is outside of UDFCD’s Boundaries (see map in attached agreement Exhibit A). Town Staff requested UDFCD to assist with the Project management of this section of Coal Creek, and to evaluate and design the section from the levee to Kenosha Road as one cohesive project. Although the Town will be responsible for the cost of the section outside of UDFCD’s Boundary, UDFCD has agreed to provide project management for this section of Coal Creek.
The Amendment to the original Agreement in front of you tonight increases the funding for the design and construction of the improvements. Once the design is complete and construction phasing is defined, additional funding is anticipated to be needed to complete the construction. Future amendments will be brought before the Board of Trustees for approval prior to additional funding for improvements.
This agreement has been reviewed by Town Staff and the Town Attorney and has found it to be acceptable.
