SUMMARY AND BACKGROUND OF SUBJECT MATTER:

Crestone Resources (formerly Encana) is proposing to install various pipelines in Town right-of-way on Weld County Road 5, 10, and 10.5.  The Encroachment Licenses will grant EnCana the right to use the Town’s right-of-way for these pipelines.  Staff has reviewed the pipeline plans and do not believe the pipeline will conflict with Town facilities.  The agreement also allows the Town to terminate the agreement at any time with a 90 day notice.

Staff is recommending approving the resolution and authorizing the Mayor to sign the Encroachment License Agreements.
