SUMMARY AND BACKGROUND OF SUBJECT MATTER:
Currently the Title 9, Chapter 4 of the Erie Municipal Code imposes requirement on special district formation that are inconsistent with state law pursuant to C.R.S. § 32-1-101, et seq., and the Town must follow the procedures set forth therein when approving a special district service plan. Therefore the attached ordinance deletes Chapter 4 of Title 9 applicants to use the Town’s model service plan and brings the code into alignment with the state requirements.
