POLICY ISSUES:

Town policy states that the decision-making process is a matter of public business and public records shall be open for inspection except as otherwise provided by law. The Public Records Policy sets the process for handling public records requests. Changes require Council approval.

Approve changes to the Policy as written.

SUMMARY/KEY POINTS

Staff recommend minor changes to the Public Records Policy as follows.

                     Pursuant to C.R.S. § 24-72-205(6), the first hour of research and retrieval time for records request shall be free of charge. The Town may charge for additional time that staff need to research and fill records requests providing the Town does not charge more than the maximum hourly fee specified by the Director of Research of the Legislative Council and that the fee is posted on the Town’s website.

                     The Town Council includes this fee in the annual Fee Schedule resolution.

                     The proposed change to the policy removes the specific fee and replaces it with a reference to the statute and notes it must be posted on the Town website. This change means the policy does not need to be updated each time the fee changes at the State.

                     Additionally, staff recommend removing language related to reviewing documents at the Town Attorney’s Office as the Town Attorney now offices at Town Hall.
