POLICY ISSUES:
The Summerfield Development Agreement (DA) reflects provisions negotiated by Town staff with the counsel of the Town Attorney, the property owner, CDG, the developer CDG sold the property to, Toll Southwest LLC, and the Town of Frederick. The DA includes, among other things, provisions addressing the timing of roadway and drainage improvements and parks. Staff's approach in negotiations was to ensure the DA reflects the requirements of the Annexation Agreement (AA), which was approved by the Board of Trustees in 2013, and, where the AA is ambiguous, to provide clarity, while also promoting the Town's interest in facilitating regional infrastructure improvements that will support other development on the east side of Erie, including the Town's I-25 Gateway property. This Professional Services Agreement is consistent with the terms of the DA and the AA.
