POLICY ISSUE:
Annexations are governed by the Municipal Annexation Act of 1965 (C.R.S. ? 31-12-101). The policy decision is limited to the Town Council's consideration of whether the petition complies with C.R.S.? 31-12-107 (1) by including the following:
? Proposed annexation meets contiguity and community of interest requirements;
? The petition is timely signed by at least 50% of the landowners comprising at least 50% of the land proposed to be annexed;
? Petition is accompanied by necessary Affidavit of Circulator; and
? Petition is accompanied by 4 copies of an annexation map showing legal descriptions and annexation boundaries.
The applicant provided a petition signed by the property owners. The area for petition for annexation falls within Erie's Planning Area and agreements with the City of Lafayette.
STAFF RECOMMENDATION:
Recommendation
Adopt the resolution stating the Annexation Petition is in substantial compliance with the laws of the State of Colorado and setting a Public Hearing on Jan. 28, 2025 at 6:30 p.m., in Erie Town Hall, 645 Holbrook Street, Erie, CO 80516.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The subject properties are located along Kenosha Road near the intersection with N 119th Street. The applicants propose to annex eight separate properties totaling approximately 86.65 acres of land into the Town of Erie municipal boundary.
