Approve Ordinance requiring Unit Owner’s Associations to register with the Town of Erie

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

In order to facilitate communication between the Town and the many home owners associations in Erie, staff requested that the Town Attorney draft an ordinance requiring all associations to register with the Town. Current Colorado law requires associations organized under C.R.S. § 38-33.3-301 to register with the state and the proposed ordinance will not conflict with this statute, but act as a supplementary local regulation. 

Requiring the associations register with the Town ensures up to date information is available when communicating with the association or their management company.

 

Registration would be completed annually and include the following information:

                     Legal name of the association

                     Physical address and mailing address of the association

                     Number of units in the association

                     Names of all board members and directors

                     Name of the associations management company, managing agent and associated contact information

 

Upon approval of this ordinance, staff will finalize the registration process and methods to share the information with staff and residents as appropriate.
