POLICY ISSUES:

Current provisions in the Municipal Code are not consistent with State law on ‘non-functional turf’. Council will consider an update to the Code to bring the Town into compliance.

 

Recommendation

STAFF RECOMMENDATION:

Adopt an Ordinance Amending Chapters 6 and 11 of Title 10 of the Erie Municipal Code Regarding Landscaping.

Body

SUMMARY/KEY POINTS

                     HB 24-005 and SB 25-113, codified as CRS Sec. 37-99-101 through 104, require municipalities to prohibit nonfunctional turf, artificial turf, and invasive plant species from being installed on the following properties:

o                     commercial, institutional, or industrial;

o                     property within a common interest community that is owned and maintained by a unit owners’ association;

o                     rights-of-way, parking lots, medians, or transportation corridors; and

o                     property with a multifamily dwelling unit containing 12 or more dwelling units.

                     Chapters 6 and 11 of Title 10 of Erie Municipal Code must be amended to comply with State law.
