STAFF RECOMMENDATION: Approve the Resolution to enter into an Intergovernmental Agreement with City of Lafayette for Emergency Water Utility Service, authorizing the Mayor to execute said agreement.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: Staff has worked with Town legal counsel and City of Lafayette staff and legal counsel to update and renew an Interconnect Agreement to provide water services to one another in the event of an emergency or supply issue. This agreement was originally established in 2003 has expired.

Interconnects in the water system are vital in ensuring uninterrupted service to our citizens during emergencies and projects which require large areas of the Town’s distribution system to be shut down, and have been effectively utilized as recent as this August. The original agreement was drafted prior to the construction of the interconnect, and most of the changes were to acknowledge that these facilities are now in place, along with updated some of the Town’s standard legal language.

The Town also has an existing Interconnect Agreement with Left Hand Water District.
