SUMMARY AND BACKGROUND OF SUBJECT MATTER:
On November 17, 2020, the Town and Developer entered into the Morgan Hill Filing 2 Development Agreement. The Town and Developer wish to amend the Agreement by the addition of a new Section 6.A. which would allow the development to be constructed in three phases.
Each phase contains specific improvements that shall receive Initial Acceptance before any building permits may be issued for that phase. Also, the amendment contains language requiring each public improvement to be permanent prior to issuance of any certificate of occupancy for each phase.
The applicant has provided an updated Exhibit C as part of this development agreement amendment. This exhibit proposes the phasing plan for the Morgan Hill Filing 2 subdivision.
