Summary and Background of Subject Matter:
The Colorado Department of Transportation (CDOT) requires local agencies to operate and maintain Permanent Water Quality (PWQ) facilities constructed to treat CDOT MS4 areas. The Parkdale Filing 1 subdivision requires widening of State Highway 7 (SH7) which necessitates the installation of PWQ facilities. The Intergovernmental Agreement (IGA) details the Town's operation and maintenance responsibilities for the new SH7 PWQ facilities.

The PWQ facilities are needed due to the Parkdale Filing 1 subdivision. Therefore, the Town will be reimbursed periodically by the Parkdale Community Authority for the actual costs related to the operation, maintenance, and repair of the PWQ facilities. The reimbursement agreement details the reimbursement process between the Town and the Parkdale Community Authority.

The reimbursement agreement was approved at the May 11, 2021 Board of Trustees meeting. The IGA was approved at the same meeting, however, CDOT was updating their PWQ IGA template at the time which was recently finalized. Therefore, the updated PWQ IGA is needing approval from the Board of Trustees.
