STAFF RECOMMENDATION:

Recommendation

Approve the Resolution accepting said permanent utility easement agreement and authorize the appropriate Town officer to execute said permanent utility easement agreement.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

 

At the November 12, 2019 Board of Trustees meeting the Board of Trustees approved the Wild Rose subdivision Final Plat on the consent agenda.  There is the possibility for future sanitary sewer connections to the Wild Rose sanitary sewer lines.  Moving the subject Town sanitary sewer manhole out of the cul-de-sac and into the adjacent metro district-owned Tract D will prevent having to cut into the road, curb & gutter, and sidewalk when making future sanitary sewer connections.  Therefore, this utility easement is needed on Tract D to construct the Town sanitary sewer manhole and sewer line which is shown in the Permanent Utility Easement Agreement as well as the attached location map.  At the March 24, 2020 Board of Trustees meeting the Board approved a similar easement in agenda item 20-169.  The developer determined that additional easement area is required from what was initially approved, therefore this resolution amends the initial easement area to the easement area required.
