POLICY ISSUES:
Staff's analysis indicates the proposed Development Agreement (DA) Amendment is consistent with Town Charter, Municipal Code, and the Council's priorities. The amendment adjusts the DA related to the phasing of landscaping improvements, and revises Exhibits B and C accordingly.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The Four Corners Filing No.1 subdivision is generally located northwest of East County Line Road and Austin Avenue. Specifically, this amendment addresses the Toll Brothers projects located on the western and southern portions of the overall site (see exhibit C of the amended DA document). The 45.478-acre plat area comprises 250 residential units within the Erie Town Center Four Corners site.
Town Council approved the Four Corners Filing 1 Final Plat and Development Agreement in August 2022. The approved Development Agreement does not phase the landscaping improvements and requires all tract landscaping to be completed prior to initial acceptance of utilities, roads, etc. This requirement results in landscaping being damaged and re-done as the development progresses.
The Town will continue to hold the original bonded amount for the landscaping improvements. The proposed amendment allows a phased approach to surety release as areas are accepted. Phasing the installation of the improvements would allow landscaping to be installed congruently with the vertical construction. This avoids having to spend extra funds and time by re-doing and fixing damaged work.
