SUMMARY AND BACKGROUND OF SUBJECT MATTER:
Kerr-McGee Gathering LLC (Anadarko) is proposing to install various pipelines in Town right-of-way on Weld County Road 10.5. The Encroachment Licenses will grant Ker-McGee the right to use the Town’s right-of-way for these pipelines and allows the Town to terminate the agreement at any time with a 90 day notice.
Staff has also recently revised the Encroachment Agreement to include three new requirements on the license holder including:
1. License holder must provide Record or As-Built Drawings of the encroachments after the pipelines are constructed.
2. License holder must place physical markers where any pipelines enter or exit Town property or right-of-way.
3. License holder must provide the Town a map showing the entire extents of the pipeline through Town limits, regardless of if it is on Town property or right-of-way.
Staff is recommending approving the resolution and authorizing the Mayor to sign the Encroachment License Agreements.
