Approve the Resolution to amend said agreement, authorizing the appropriate Town officer to execute said agreement, authorize new appropriation and authorize staff to expend budgeted funds.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The 2019 Water Fund Budget has funds appropriated for constructing the Water Treatment Plant Expansion. Additional Funds will need to be appropriated to fully fund the construction and Construction Administration for this project.
At the June 12, 2018 Board Meeting, the Board authorized the Award of a Consultant Contract to Burns & McDonnel, Inc. for the Water Treatment Facility Expansion Design.
During the early design phase, staff determined it would be in the Town’s best interest to bring in a contractor early, on a Construction Manager at Risk contract. Construction Manager at Risk (CMAR) is a common design-build contracting process. It differs from the traditional design-bid-build process in the sense that a contractor is selected early in the design (typically at 30% design) to provide input on constructability and provide "real-world" cost estimates. Using a competitive process, the Town selected Garney Companies, Inc. for the Construction Manager At Risk (CMAR).
Burns & McDonnell, the Town and Garney worked closely during the 60% design and 90% design to arrive at a Guaranteed Maximum Price (GMP) for the Water Treatment Facility Expansion.
In addition to this resolution, on the agenda tonight is a resolution for the approval of Amendment No. 2 to the CMAR contract with Garney Companies, Inc. for The Lynn R. Morgan Water Treatment Facility Expansion in the amount of $8,750,768. (Agenda Item 19-222).
Assuming that Amendment No.2 for the CMAR Contract would be approved, Burns & McDonnell, Inc. was asked to provide a cost for construction administration. The construction administration services will include inspection, documentation and oversight during construction and geotechnical testing services. The Town’s construction inspectors are focused on construction inspection and oversight of residential and commercial development. Due to the complexity of this project, and to assure accountability, staff believes it is in the Town’s best interest to have the design firm provide construction administration services.
Accordingly, staff recommends awarding the professional services construction administration contract for the water treatment plant facility expansion to Burns & McDonnell, Inc., in the amount of $806,722.

Staff recommends that funds for the new appropriation come from another waterline project where the design is not ready for bidding. At this time the Zone 3 Waterline Extension Phase 2 project is still working out easements to firm up the alignment. The design cannot be complete until this is done. Staff does not believe the entire line will be under construction this year. Based on this status, funds in the amount of $2,322,937 could be transferred from the Zone 3 Waterline Extension Phase 2 project (account number 500-70-110-605000-100228) into the Water Treatment Plant Expansion project (account number 500-70-110-605000-100258).
