The policy issue is to maintain a full appointed Board of Commissioners for TOEURA and have active representation by the County(ies) on the TOEURA Board, as required by State statute.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

Pursuant to C.R.S. § 31-25-104(2.5), as amended, the Town of Erie Urban Renewal Authority (“TOEURA”) is comprised of Board Members representing the collective interests of the Town, county(ies), and all taxing bodies levying a mill levy within the boundaries of TOEURA, including one member who is “appointed by the board of county commissioners of the county in which the territorial boundaries of the urban renewal authority area are located" (the "County Appointee Position"). 

 

Weld County Commissioner Lori Saine has been serving as the County Appointee since May 2022, but following the November 2024 election, this County Appointee Position is now vacant. The Mayor, with the consent of the Town Council, desires to appoint an individual to fill the vacant County Appointee Position.

 

The territorial boundaries of the Town of Erie Urban Renewal Authority Area are located within both Weld County and Boulder County. C.R.S. § 31-25-104(2.5) provides that “if the urban renewal authority area is located within the boundaries of more than one county, the appointment is made by agreement of all of the counties in which the boundaries of the urban renewal authority area are located”.

 

Town Manager and TOEURA Executive Director Fleming contacted the Boulder County and Weld County Commissioners to request that they nominate a representative to fill the County Appointee position vacancy. Boulder County deferred the nomination to Weld County, requesting that whoever is appointed by Weld reach out to Boulder County to share perspective and seek input on URA decisions within Boulder County. The Weld County Board of County Commissioners nominated new incoming Commissioner Lynette Peppler.

 

Acknowledging the nomination by Weld County, and the deferral by Boulder County, the Mayor, with the consent of the Town Council, desires to appoint Lynette Peppler to be a board member of the TOEURA to fill the County Appointee Position.

 

The TOEURA is responsible for six existing URA Plan Areas, including four in Weld County (Colliers Hill, Historic Old Town, Erie Airport and Erie Gateway Phase 1) and two in Boulder County (Four Corners and Nine Mile). One additional new URA Plan Area is also being considered for the Erie Town Center project in Boulder County.
