POLICY ISSUES:
Approving the License Agreement with Regional Transportation District (RTD) allows for the construction of Canyon Creek Filing No. 7 and 8 Subdivisions. Specifically, the Town agrees to abide by standard RTD requirements when constructing improvements that impact RTD right-of-way.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
On Nov. 14, 2023, the Town Council approved the Canyon Creek Filing No. 7 and 8 Development Agreements and accepted dedications as shown on the final plats for each filing.
Certain portions of the Canyon Creek developments will impact RTD’s property and railroad right-of-way in the vicinity of Jay Road and Lombardi Street. The improvements involve the extension of Lombardi Street across the railroad tracks where it will intersect with a roundabout at Jay Road. Below is an image of the area and proposed improvements:

On Mar. 26, 2024, the Town Council approved the RTD License Agreement with the Town for the three Canyon Creek Filing No. 7 and 8 development utility crossings of the RTD right-of-way. The Lombardi Street crossing of the RTD right-of-way needs a separate License Agreement.
The Canyon Creek Developer will perform the construction and installation of the Lombardi Street improvements and be responsible for the operation and maintenance of the improvements until they are dedicated and accepted by the Town. RTD and the Developer entered into a License Agreement previously, but an agreement is also required with the Town.
Approving this License agreement with RTD ensures the timely and efficient construction of the Canyon Creek development.
