POLICY ISSUES:

Staff’s analysis indicates the proposed Development Agreement (DA) Amendment is consistent with the Town Charter, Municipal Code, and the Council’s priorities. The developer of Colliers Hill is obligated to build a connection from the Colliers Hill neighborhood to Old Town Erie. The amendment supports the overall health and safety of the community by ensuring the trail is constructed with financial contributions from the developer.

STAFF RECOMMENDATION:

Recommendation

Approve the Second Amendment to Development Agreement for or Colliers Hill Subdivision Filing No. 4D and 5.

End

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

Colliers Hill Subdivision Filings 4D and 5 are located north and northeast of Colliers Boulevard and the Mount Pleasant Cemetery. Both filings comprise neighborhoods of single-family detached homes.

The developer of Colliers Hill is obligated to build a connection from the Colliers Hill neighborhood to Old Town Erie. Staff have been working with the Colliers Hill development team to identify the most ideal connection route from the neighborhood. Through collaboration with the development team, Planning, Engineering, and Parks & Recreation designed a pedestrian trail through the Coal Creek Open Space. The trail will connect to an existing crossing of the Erie Coal Creek Ditch and terminate at the edge of the existing RTD right-of-way on the west side of the property. An at-grade railroad bed crossing and bridge over Coal Creek, currently in design by the Town, will connect the trail to Coal Creek Park and Downtown Erie. The Development Agreement amendment captures the additional surety required for the additional trail work.

Site History and Prior Approvals

1.                     Annexation

•                     The Town annexed the Colliers Hill area in October 2007.

2.                     Zoning

•                     The Town zoned Colliers Hill concurrently with the Annexation in 2007 with the following districts and overlays:

•                     LR - Low Density Residential

•                     SR - Suburban Residential

•                     ER - Estate Residential

•                     AG/OS - Agriculture/Open Space

•                     Colliers Hill Planned Unit Development (PUD) Overlay District

•                     The Town approved six different amendments to the Colliers Hill PUD Overlay over the years. The amendments created architectural standards and introduced different housing types into the overall development.

3.                     Plats

•                     The Town reviewed a Sketch Plan that included both filings in 2014 for the Colliers Hill property. A Sketch Plan is an informal evaluation before detailed planning and engineering work is undertaken and does not result in any action regarding approval or denial.

•                     Town Council approved Preliminary Plat No. 2 that included both filings of the Colliers Hill site in May 2016. The Preliminary plat proposed 726 single-family detached lots and 41 tracts for various landscaping, trail, park, open space, amenities, utilitis, and future development areas.

•                     Town Council approved the final Plat and DA for Colliers Hill No. 4D in September 2019.  Filing 4D created 126 single-family residential lots.

•                     Town Council approved the final Plat and DA for Colliers Hill No. 5 in October 2020. Filing 5 created 53 single-family residential lots.

•                     Town Council approved the First Amendment the Development Agreements for Colliers Hill Filing No. 4D and 5 in March 2021. That amendment clarified developer responsibilities for construction of open space areas to include landscaping and trail improvements on certain tracts and adjusted the Exhibit B accordingly.
