POLICY ISSUES:
The Summerfield Development Agreement (DA) reflects provisions negotiated by Town staff with the counsel of the Town Attorney, the property owner, CDG, the developer CDG sold the property to, Toll Southwest LLC, and the Town of Frederick. The DA includes, among other things, provisions addressing the timing of roadway and drainage improvements and parks. Staff’s approach in negotiations was to ensure the DA reflects the requirements of the Annexation Agreement (AA), which was approved by the Board of Trustees in 2013, and, where the AA is ambiguous, to provide clarity, while also promoting the Town’s interest in facilitating regional infrastructure improvements that will support other development on the east side of Erie, including the Town’s I-25 Gateway property. This Professional Services Agreement is consistent with the terms of the DA and the AA.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
In July 2023, the Town of Erie approved and executed a Development Agreement with CDG Summerfield Inc. for the Summerfield Development- Filing Number 1 located south of Highway 52 between Weld County Road 5 and 7. In Section 3. j. of the Agreement, the Town of Erie is obligated to work with the Developer and the Town of Fredrick to develop an IGA identifying improvements and cost sharing of the downstream drainage impacts for future development that will occur south of Highway 52.
The intent of the IGA and design plans in the contract scope of work are to identify a regional drainage solution including 50% design level construction plans for a drainage crossing at Highway 52, and 30% design level effort for the upstream and downstream drainage channel crossing Highway 52. The design effort will work in partnership with the Town of Fredricks’ needs on the north side of Highway 52 to identify the intended drainage path and any facility constraints ending at the I-25 Frontage Road. Additional analysis will be provided upstream of Highway 52 to determine pond volume capacity needs. Once complete the analysis will allow identification of high-level challenges and costs associated with the completion of the Erie/ Frederick IGA. Per the DA this work effort, and the IGA, should be completed within 5 years of execution of the 2023 Development Agreement.
As part of the pre-design scoping effort, a meeting was held between the Town of Erie, Fredrick, and CDOT. At that meeting, it was identified that CDOT would not allow un-detained flows passing Highway 52, and a structural analysis would be necessary with the 50% design effort. Fully developed flows from both Summerfield and the upstream drainage basins will total 1,165 cubic feet per second.
The Town of Erie issued a Request for Proposals due on Nov. 21, 2024. Seven proposals were submitted from the following firms:

Following review and consideration of the proposals, the selection team chose Kimley Horn & Associates as the preferred design firm based on their understanding of the project needs and a strong design team presented with the proposal.
To complete this project, staff asks the Council to approve the Resolution and Professional Services Agreement with Kimley Horn and allow staff to transfer $275,000 to Budget Line Number 520-75-110-605000-257524 Hwy 52 Drainage crossing Project from 520-75-110-5601000-000000 Consultation Services.
