SUMMARY AND BACKGROUND OF SUBJECT MATTER:

On July 12, 2022, the Town Council approved a professional services agreement between the Town and Felsburg, Holt & Ullevig (FHU) to design the Colliers Hill-Historic Downtown Erie Connection project. The project design includes a pedestrian/bike path described as follows:

•                     Beginning at Coal Creek Park, a bridge will extend over and to the east side of Coal Creek to a landing plaza;

•                     From the plaza area a 10’ trail will extend eastward to the rail road right-of-way; and

•                     A 10’ wide concrete at-grade trail crossing, will extend over the Boulder Industrial Lead rail track and right-of-way, that is owned by the Regional Transportation District’s (RTD), the “Licensed Area”.

Below is an image of the Licensed Area and planned improvements.

The key terms of the RTD License Agreement provide for:

•                     The Town to obtain a non-exclusive, revocable license and permission to enter RTD property to construct, use, operate and maintain the at-grade trail crossing;

•                     Town to pay RTD the sum of $3,500 in consideration of mutual promises, upon execution of the License Agreement;

•                     The RTD rail track has been under lease to the Colorado Railbike Adventures (CRBA) since Oct. 20, 2022; the Town is required to coordinate all construction and maintenance of the its at-grade trail crossing, and provide advance notice of operations to RTD and CRBA; and

•                     Town is required to reimburse RTD for any prorated reduction of rent payable from CRBA to RTD as a result of Town’s closure of the tracks greater than two (2) days due to construction and/or maintenance of the at-grade trail crossing.

Approving the license agreement now with RTD will enable the Town to stay on-schedule to construct the project; and obligate the Colliers Hill development to construct the pedestrian trail, at their own expense, from the eastern boundary of RTD’s right-of-way to Weld County Road 3 (Colliers Boulevard); a requirement established in the Bridge Water Annexation Agreement executed on Oct. 9, 2007.
