POLICY ISSUES:
This amendment to the IGA would update the cost sharing provisions to reflect actual costs. Otherwise, the key provisions are consistent with the terms of the IGA previously approved by the Council, which established cost sharing based on jurisdictional boundaries and relative contribution of impacts. The Lafayette City Council approved the First Amendment to this IGA at its Oct. 1, 2024 meeting; and has executed the attached First Amendment.

Approve Resolution No. 24-162 to revise the cost sharing IGA between the Town of Erie and the City of Lafayette; and extend the completion date for project construction.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The Town of Erie staff is working with the City of Lafayette staff to improve the safety at the intersection of 111th Street and Arapahoe Road. The intersection is located within the boundaries of both the Town of Erie and the City of Lafayette. See the attached Vicinity Map.
In May 2023, in accordance with adopted Resolution No. 23-056, the Town of Erie (the Town) and City of Lafayette (the City) executed an Intergovernmental Agreement (IGA) for cost sharing in the design and construction and reimbursement to Erie for City’s share of costs for this intersection safety improvement project. At that time, the cost estimates were based on conceptual studies.
The Town and the City have completed the preliminary design and construction cost estimates; which indicate increased construction costs based on detailed preliminary design and refined quantity estimates; as well as the inclusion of pedestrian safety features such a new crosswalk and concrete walkway, PED Ramps and Pedestals.
Proposed First Amendment to IGA:
This amendment identifies the revised design and construction cost and shares based on a 75% Erie/25% Lafayette ratio that was part of the original IGA. The initial and proposed costs and shares are summarized as follows:

In addition, this amendment extends the Town’s obligation to complete the project construction by May 30, 2025.
Approval of this proposed First Amendment will enable the City of Lafayette to exercise its discretion to provide written approval for the project to move forward into final design; a requirement of the original IGA.
Staff has reviewed this amendment, finds the provisions acceptable, and recommends approval of the proposed First Amendment to the IGA with the City for the cost sharing and reimbursement to the Town for the City’s share of costs.
