POLICY ISSUES:
The Town Council is the approval body for the Annexation and Initial Zoning; as such, the Council must confirm the zoning designation is consistent with the Town’s vision and is in the best interest of the Town.
STAFF RECOMMENDATION:
Recommendation
Staff find that the application complies with the Initial Zoning approval criteria in UDC Section 10-7-4. The Council found at its Feb. 25, 2025 meeting that the Annexation met criteria and passed Resolution No. 25-019. Consistent with that action, staff recommend adopting Ordinance No. 006-2025, annexing and zoning the properties.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The Erie West Annexation includes eight parcels and street right-of-way totaling 86.65 acres, located near the intersection of North 119th Street and Kenosha Road. These eight private properties and streets are currently located in unincorporated Boulder County. The area is located within the Town’s Comprehensive Plan Planning Area Boundary. The Future Land Use Map designates this area as Agriculture land use, which is consistent with the current use of the properties.
Under the proposed Agricultural Holding (AGH) zoning, the property owners may continue to use their properties as they currently do - as rural/agricultural properties with single-family dwellings and accessory buildings. According to the Town’s Unified Development Code (UDC), the purpose of the AGH zone district is to provide for the continuance of existing agricultural-related uses on land annexed into the town until such time the annexed sites are redeveloped. The AGH district does not compel a property owner to develop. This purpose of AHG zoning is consistent with the intent of the property owners, who desire to retain their current rural and agricultural character and continue using their properties as they do today. In the future, should any of the property owners desire to redevelop to a different or more intensive land use, a zone change would be required.
Left Hand Water District currently serves the properties with water infrastructure. Each property possesses a septic system to handle sanitary sewer needs. In accordance with the UDC, this utility infrastructure may remain in existence until the point in time when redevelopment necessitates extension of utility lines, which will be the responsibility of the property owner(s).
Town Council heard testimony at its February 25, 2025 meeting regarding the eligibility of the properties to be annexed, ultimately adopting Resolution No. 25-019 determining the properties eligible for annexation. The action item associated with this case is the ordinance to annex and approve the initial zoning. The staff report outlines further information and provides staff’s evaluation of the approval criteria.
