SUMMARY AND BACKGROUND OF SUBJECT MATTER:
In July 2021, based on the anticipated property tax increment generated by the Erie Commons residential development in the Historic Old Town Urban Renewal Area (URA), the Town of Erie Urban Renewal Authority (TOEURA) issued tax increment revenue bonds to finance various Downtown Infrastructure Improvements identified in a Downtown Infrastructure Audit in April 2020. The bonds generated approximately $2.9M for improvements in the Historic Old Town URA.
In May 2022, the Town Council approved a Professional Services Agreement with RockSol Consulting Group, Inc. for the Design and Engineering of the Downtown Infrastructure Improvement Project for a fee of $548,384. Considering input from residents and business leaders and budget constraints, RockSol was directed to prepare the construction bid documents to identify improvements at the following locations:
• Briggs Street Streetscape (500-600 Blocks)
• Intersection Improvements (in order of priority)
o Kattell & Cheesman
o Kattell & Moffat
o Briggs & Balcolm
o Cheesman & Pierce
o Cheesman & Main
o Wells & Main
Staff posted a request for construction bids on BidNet Direct for the Downtown Infrastructure Improvements (DII) Project on Jan. 5, 2024. The request for bids required potential bidders to submit pricing for the Briggs St. Streetscape and all intersection improvements; and notified bidders that budget constraints may require elimination of scope and reduction of the low bidder’s price depending on the actual bids received.
Staff then held a non-mandatory pre-bid meeting on Jan. 12, 2024.
Contractors submitted the following bids on Feb. 5, 2024:
Contractor Base Bid Amount Bid Bond Included
Mountain Constructors $2,878,079.00 Yes
Goodland Construction $2,998,994.25 Yes
Duran Excavating, Inc. $3,088,524.45 Yes
Native Sun Construction $3,560,548.79 Yes
Engineer’s Estimate $2,466,398
Mountain Constructors is the Low Bidder, however, the budget available is $2,399,697; and staff negotiated a scope and fee with Mountain Constructors for a final bid price of $2,077,903; and a Sept. 20, 2024, construction completion date. At this price, only the Briggs St. Streetscapes can be completed, and street intersection improvements are not included. See the attached Construction Vicinity Map.
The Briggs Street Streetscapes improvements will include:
• New Street Lights
• Masonry Pavers and Bands
• Concrete Curb Bulb-out and gutter and pedestrian ramp upgrades
• New Signage
• Trash/Recycling Receptacles
• Silva Cells and Tree Planting
• Shrubs, Perennials and Grasses
• Irrigation System
• Art Protection
• Seat Wall with recycled Flagstone Capstone, Backed Benches, Bicycle Racks
Staff checked references for Mountain Constructors, and staff believe they are qualified to construct the project.
Fiscal Impact:
A total of $2,399,697 is available in the 2024 Historic Old Town Urban Renewal Area budget for this project.
Staff believes it is in the Town’s best interest to construct the project at this time in order to comply with the October 2024 deadline to expend the bond funds and recommends awarding the construction contract to Mountain Constructors, for $2,077,903 and a contingency amount of $207,790 for a total contract amount of $2,285,693.
