SUMMARY AND BACKGROUND OF SUBJECT MATTER:
On July 12, 2022, the Town Council approved a professional services agreement between the Town and Burns & McDonnell Engineering Company for the design of the Zone 3 Weld County Road 7 Waterline Improvements project. The design effort is currently at 90% completion, and requires an underground pipeline crossing on Weld County Road 7 of the Regional Transportation District’s (RTD) railroad right-of-way and the existing Boulder Industrial Lead (BIL) rail track. The crossing will include:
• Removal and re-construction of the rail tracks;
• Cut-n-cover trench excavation and backfill construction methods; and
• Installation of one (1) 16-inch water pipeline in a 24-inch steel casing at a depth of 7-feet below the base of existing rail track.
Below is an image of the Licensed Area and planned improvements.

The key terms of the RTD License Agreement provide for:
• The Town to obtain a non-exclusive, revocable license and permission to enter RTD property to construct, use, operate and maintain the underground pipeline crossing of the BIL rail track;
• Town to pay RTD the sum of $3,500 in consideration of mutual promises, upon execution of the License Agreement; and
• Town is required to coordinate all construction and maintenance of the underground pipeline crossing, and provide advance notice of operations to RTD.
Approving the license agreement now with RTD will enable the Town to stay on-schedule to complete construction of the project; and meet the obligation to provide water to the Summerfield development; a requirement established in the 2013 Annexation Agreement.
