SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The Town owns and maintains the existing roadway and bridge at the Weld County Road 3 crossing over the Lower Boulder Ditch located approximately .25 miles south of State Highway 52.

 

At this location, the New Consolidated Lower Boulder Reservoir and Ditch Company (Lower Boulder) and Northern Colorado Water Conservation District (Northern Water) jointly own the Lower Boulder Ditch and ditch easements; which are used by Lower Boulder to convey irrigation water through an existing ditch culvert under Weld County Road 3, to shareholders and other users.

 

This License Agreement will provide the Town permission for the following activities within the Northern Water and Lower Boulder ditch easements:

 

1. Relocate and extend the existing culvert;

2. Widen the roadway in the future;

3. Extend the roadway crossing over the ditch; and

4. Operate and maintain the roadway and bridge.

 

As consideration for mutual promises under the License, the Town is required to pay Northern Water $500.00; and pay Lower Boulder $2,500. In addition, Town is required to reimburse Northern Water and Lower Boulder reasonable legal, engineering cost, costs incurred in negotiating, preparing, finalizing, recording and ensuring deadlines are complied with as set forth in the License Agreement.

 

Design for the bridge replacement project has been completed by the Town. The design includes replacement of the existing bridge and culvert with an extended concrete box-culvert to convey the irrigation water under the roadway while supporting the road above. Staff received competitive construction bids and will be requesting approval of a construction contract for the Weld County Road 3 Bridge Replacement project at the Oct. 22, 2024 Town Council meeting.

 

Approval of this License Agreement by Council enables staff to implement the bridge replacement project and complete “essential repairs” on schedule. Approval also enables staff to utilize $1,036,368 in CDOT grant funding pursuant to the executed IGA authorized by Town Resolution No. 23-112.

 

This License Agreement has been reviewed by the Town’s Water Attorney, Vranesh and Raisch, LLP, and has been deemed acceptable for Town signature.
