The policy issue is to meet the Town Council’s statutory obligation to appoint Directors to the Four Corners Business Improvement District (BID), allowing their Board to maintain full representation of five Directors.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The Erie Four Corners Business Improvement District (BID) was approved by the Erie Board of Trustees (now Town Council) on Sept. 27, 2016, to help finance the construction of public improvements for the Four Corners development at the Southwest corner of Erie Parkway and E. County Line Rd. The Erie Four Corners BID is a separate governmental entity, governed by a Board of Directors, consisting of five (5) Directors. Section 31-25-1201 et seq., C.R.S. (the “Business Improvement District Act”) governs BIDs and provides the authority under which the Erie Town Council appoints Directors to the BID Board of Directors, all of whom must own or lease property within the BID.
The current Erie Four Corners BID Board of Directors consists of four representatives of the land development team (who own/lease real property in the boundary) and one vacancy.

The Four Corners BID emailed Town staff in Oct. 2024 to request that the Erie Town Council approve legislation to appoint Mr. Walter Pounds to the BID Board at earliest convenience. Mr. Pounds is the majority owner of Erie Four Corners, LLC, the original landowner and developer for the Four Corners development at Erie Town Center.
Staff have attached qualifications materials to this agenda item for both Mr. Pounds and the other four existing BID Directors for review by Town Council. Representatives of Erie Four Corners will attend the meeting on May 27 to provide Town Council with a brief overview of the Four Corners BID and respond to any questions on its role and responsibility.
