A Resolution of the Board of Trustees of the Town of Erie Approving a Development Agreement and Accepting Dedications as Shown on the Final Plat for the Canyon Creek Filing No. 7 Subdivision

POLICY ISSUES:

The Canyon Creek Filing No. 7 Development Agreement (DA) reflects provisions negotiated by Town staff with the counsel of the Town Attorney, and the property owner, Stratus Canyon Creek, LLC. The DA includes, among other typical Town language, provisions addressing or requiring items to support the previously approved Lafferty Canyon Metro District in March 2023. Requirements include:

                     plugging and abandonment of oil and gas wells and subsequent monitoring,

                     installation of solar panels on a portion of the units,

                     provision of energy efficient fixtures,

                     monetary contribution towards the Town’s affordable housing program, and

                     monetary contribution towards necessary transportation safety improvements within the development.

Approval of the DA is consistent with the Board’s policy objectives for metro districts and development and will be beneficial to the Town.  

STAFF RECOMMENDATION:

Recommendation

Approve the Development Agreement and accept the dedications shown on the Final Plat for the Canyon Creek Filing No. 7 Subdivision.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The Canyon Creek Filing No. 7 subdivision is generally located northwest of Jasper Road (future Lombardi Street) and Telleen Avenue. The site has been identified for residential single-family detached units as part of the Canyon Creek Planned Development - Development Plan.

Site History and Prior Approvals

1.                     Annexation

                     The overall Canyon Creek area (including Filings 7 and 8) was annexed by the Town in September 1970, and was originally known as “Homestake”.

 

2.                     Zoning

                     The properties and surrounding area were zoned as the Homestake PUD in 1975.

                     In May 2001 the Homestake PUD was amended and renamed the Canyon Creek Planned Development (PD) Plan.

                     Filing No. 7 of the PD was designated for 110 Single Family Detached units.

                     The Canyon Creek PD was amended in 2021 to allow alley-loaded products within Filing No. 8.

3.                     Plats

                     A Sketch Plan was reviewed in 2019 for the property. A Sketch Plan is an informal evaluation before detailed planning and engineering work is undertaken and does not result in any approval or denial.

                     The Board of Trustees approved a Preliminary Plat for Canyon Creek filings 7 and 8 on August 10, 2021. The plat proposed 106 single-family detached residential lots in Filing No. 7 and 88 alley loaded paired homes in Filing No. 8.

4.                     Metro District

                     The service plan for the Lafferty Canyon Metropolitan District was approved by the Board of Trustees in March 2023.

                     Approval of the district reflected consideration of the Town’s Special District Review Policy. Although the project was in progress for several years prior to the Town’s policy, the applicant recalibrated aspects of the project to fulfill the Town’s values of housing affordability, sustainability, and public benefits.

Canyon Creek Filing No. 7 Final Plat

Development Information:

                     Plat Size:                     70.626 acres

                     Number of Lots:                     106 single-family detached lots

                     Number of Tracts:                     11 tracts

 

The plat encompasses 70.626 acres and includes 106 single-family detached lots. Included within the plat are a series of internal trails, sidewalks, a spine trail and a pocket park. The development is accessed from a central extension of Jasper Road (future Lombardi Street), which would be extended to the north and transition into a round-about where it intersects with Jay Road.

 

Development Agreement

Staff negotiated the Development Agreement (DA) in concert with the Final Plat. The agreement includes cost estimates and reimbursement provision for public infrastructure associated with the development. Also included in the DA are items to support the Town’s metro district policy as discussed above. These provisions reflect the terms of the Annexation Agreement for the site and address additional public improvements identified as part of the development review process.

Action Items

The Board of Trustees is the approval body for both the DA and the acceptance of dedications as shown on the Final Plat.

 

Fiscal Impact

The development will pay building permit fees and will generate sales taxes and other taxes to the Town, County, School and Fire Districts. The resulting revenue will be used to provide municipal services to support the new development. In addition, two separate cash contributions will offset transportation improvements for the development and help fund the Town’s affordable housing program.
